(The copy of this Will is very hard to read so probably it has been misinterpreted in places)

- to my wife Elizabeth the property called Coffers when Philip lived, and then afterwards it is to go to his son John.  The furniture was also to go to Elizabeth.  After her death it was to be divided between the three children, John, Julianna and Caroline.  If they could not agree it was to be sold and the money divided between them

- to his son John and son-in-law John TOBY the property called Sowford, and Tuckers Orchard.  Whilst his wife was alive she was to have the rents, and then, during the minority of his grandchildren, Julia Mary Lee, John Lee and William Henry Lee the rents were to be used for their care and education

- to son-in-law John TOBY land and premises called Cross Parks in Harpford, and Poppleford Bros apparently on payment of £100

- other property to his wife, and after her death to his daughters, Julianna and Caroline TOBY

- John TOBY to pay his wife £7.10s. a year, and two year after Philip's death John TOBY was to receive £100

- residue of estate to his wife Elizabeth

In 1851 Thomas WHEATON was shows on the census as Father-in-Law, widower.  First in the house on the census was Mary Ann PLANT, (see name of person present at death so this is probably a misreading of FLINT) unmarried, daughter, age 17.  Was, therefore, Thomas her step-father?  Also in the property was Elizabeth CITTERN a niece from Twyford, Buckinghamshire, and a nephew, William ROGERS from Charndon in Buckinghamshire.  There was also a servant from the same place.

 

On the IGI there is the following entry:

WHEATON Mary Ann married Thomas PLANT on the 26 November 1832 at All Souls, St Marylebone, Middlesex. Several members of the family of Thomas and Elizabeth married at this church.  This would then suggest that the "daughter" on the 1851 census could have been the daughter of Mary Ann WHEATON and Thomas PLANT.  However, a Mary Ann has not yet been found as daughter of Thomas and Elizabeth.

 

As Mary Ann is shown as "daughter" on the 1851 census it is likely that Elizabeth CITTERN and William ROGERS are the niece and nephew of Mary Ann's father, rather than of Thomas WHEATON.  Further research required.

        TREWMAN'S EXETER FLYING-POST, March 27 1845

                        DEVON ASSIZES

                                 (continued from our last)

James Wheaton, 35 was indicted for having on the night of the 1st March instant, at the parish of Aylesbeare, broken and entered the shop of William Hare, and stolen therefrom a pair of shoes and other articles of property.  In this case Mr Elliott was for the prosecution; Mr Cornish for the defence.-  William Hare, the prosecutor. keeps a shop at Newton Poppleford, in Aylesbeare.   On the 2nd March, on going to the shop, found a ladder against the front and entering, found it in confusion.  The back door was open.  A hole had been made through the wall over the back door, and the ceiling of the shop cut through, and this an entrance had been effected.  There were footsteps in the garden behind, which the prosecutor traced some 300 or 400 yards quite to the prisoner's house.- Charlotte Hare, daughter of the prosecutor, attends this shop, and at ten at night on the 1st of March, fastened everything safely, locked the doors, and took the keys away with her.  Three pairs of shoes were at that time hanging in the window.  One pair of these, with various other articles were stolen and carried away.-  William Davey, is a policement at Ottery, and on the 2nd March searched the house of the prisoner at Newton Poppleford, where he found, wrapped in dirty linen, and concealed in a basket, a pair of shoes.  The prisoner said he had had the shoes some time; had bought them at Exeter, but did not know of whom.  The shoes were identified by Hare; and also, as having been sold to him be a shoemaker at Ottery.  The Jury found the prisoner guilty, and he was sentenced to be transported ten years.

He stated this offence "...stealing a pair of shoes from a shop, property of Mr William Hare in Aylsber".  Married, with six children.  Surgeon's Report: "Well behaved".  Protestant.  Can read and write.

Following a period of labour in the Prisoner's Barracks, Hobart he was assigned to the Convict Station at South Port, probably on 16th December, 1846.

 

Colonial Offences and Sentences:

24 December, at Lymington.  Miscondict in undertaking work which he was not ordered to perform.  It was recommended that his period of probation be extended for three months.

21 June 1849. South Port.  Insolent in refusing to hire at a resonable rate of wages.  Several days solitary.

2 July 1849. Prisoner's Barracks, Hobart.  Absconding.  Three months imprisonment and hard labour at the Old Wharf.

14 January 1851.  Received a Ticket of Leave.

28 June 1852. TL/Hobart.  Insolent in creating a disturbance by fighting.  Six days solitary.

14 June 1853 Conditional Pardon approved.

18 December 1860. Franklin.  Stealing timber at Oyster Cover.  Three months imprisonment and hard labour.

Thomas gives his age as 36 (born 1845) and his place of birth as Somerton, Middlesex.  The ages of his children, and the places in which they were born also differ.  More research is required to determine whether he has given the correct information, and the details collected are incorrect, or whether Thomas was not always accurate in remembering dates and place.  As I have since sorted out most of the WHEATONs, although details given by Thomas are not always accurate, there are no other entries for any other children which match those in this family.
