Living with them was an Elizabeth WHEATON age 15, so too young to be a daughter. It
is probable that she was actually Elizabeth SEARJEANT sister to Ann, William's wife.

The details given by this particular William do not correspond entirely with the information we have for "our" William. However, given the outcome of the offence it could be that he was endeavouring to protect his wife and family. He stated that he was a Butcher and a Beerhouse Keeper and that he was born in Somersham, Huntingdonshire, although he also stated that he was unmarried and the age given indicates that he was born in 1817, four years later then this William.

A William WHEATON, "late of Conington, Cambridgeshire" was tried at the Easter Quarter Sessions 1852 (8th March). He was tried for for sheep stealing, found guilty and sentenced to be "transported for the term of his natural life".

In later Census returns this William is not with his wife and children and we can trace no other records for him. It would suggest, therefore, that this William spent the rest of his life in Australia.

Easter 1852 -
This Day an Indictment was preferred by Philip Kirby against William Wheaton late of the Parish of Conington in this county laborer for Sheep stealing Which Indictment was found by the Grand Jury to be a True bill And the said William Wheaton being present here in Court and having heard the said Indictment read pleaded Not Guilty thereto and put himself upon the Country but upon Trial was convicted Whereupon it was considered by the Court and ordered that the said William Wheaton be transported for the term of his natural life to such place beyond the seas as Her Majesty by and with the advice of Her Privy Council shall be pleased to direct.

In 1851, in the Castle Gaol, Cambridge, Cambridgeshire there was a William WHEATON. He stated that he was unmarried, a Butcher and Beerhouse Keeper and that he was born in Somersham Huntingdonshire. Was this the same William WHEATON as the one sentenced to be transported?
Given that the William WHEATON in the prison is shown as a Butcher, and that his birth place was given as Somersham, and as all WHEATONs in Somersham so far discovered are all descended from the same Thomas (c1700-1754), the William in prison in 1851 must be one of ours. However, we had thought he was married with children!
With his age shown as 34, he was therefore born in 1817. There are two contestants. William (born 1813/1816), son of John and Alice (Chart 0604) and William (born 1813, baptised 1817), son of Robert and Mary (Chart 0602). The son of John and Alice is on the 1871 Census; the son of Robert and Mary is on the 1841, but in 1851 he is not with the family we thought were his.
There is still uncertainty because at this date the woman we thought was his wife was calling herself Ann MARTIN. And, of course, the William in Cambridge gaol said he was unmarried, and the one transported was "late of Conington", where, so far we have found no other WHEATONs.
Further research is to be carried out to try to solve the problem.


Records in Australia show the following:

"WHEATON, William: (Convict no 3151), born 1816, unmarried, butcher, semi literate, protestant, convicted Cambridge 1852, stealing sheep, prev.conv.life; arrived per the RAMILIES 7.8.1854. Ticket of leave 11.5.1857, conditional pardon, 12.8.1861, Perth".

The "RAMILIES" was a barque built at Sunderland in 1850. The master was Chas HODDER, and the surgeon Daniel RITCHIE. The ship left London on 20 May 1854 and stopped at Plymouth and Gibraltar. Two hundred and eighty males were embarked of which one hundred and sixty were landed at Gibraltar, but then another one hundred and fifty seven were taken on board. This made the complement on leaving Gibraltar two hundred and seventy seven. The journey took seventy nine days which was considered to be something of a record, especially with the two ports of call.

Details from the Perth "Convicts" Web site:

William’s registered number was 3151, he was a Butcher and single, with no children. He was 5’ 4¾” tall, with brown hair and hazel eyes. His face was oval and he had a fair complexion. He was of a stout build with no distinguishing marks. His sentence was for life for sheep stealing, and his age 38 years.

On the 20th July 1849 in the in the Court, Land & Probate, England & Wales, Criminal Registers, 1791-1892, Cambridgeshire a William WHEATON was convicted of sheep stealing and given a sentence of two years. In the documents for the 1852 William WHEATON trial information was included that he had been convicted previously for the same offence. Therefore it is probable that this 1849 trial was for this William WHEATON.

Overseers Rate Book
February 1837 There are entries showing a Robert WHEATON occupying a House and Co and a House and Garden, the property of Wm MASON and John SOCKET respectively. The total Rateable Value was £5.16s. 4d and the rates 7/2½d.
It was decided that the Robert referred to was probably this one (despite the fact he did not marry until 1838) because of the reference to BENTON and Cranbrook in later entries which
are given below.

There are references in the Rate Books to a John WHEATON. At the present time, although it refers to a Beerhouse, it would seem that this is the only John WHEATON in Somersham at this date. Slater's 1851 Directory lists a John WHEATON in Somersham, Huntingdonshire as a Retailer of Beer. Highway Rate Book 17th July 1848 John was shown as occupying a Beer House with a Rateable Value of £8. 0s. 0d. At 6d. in the £1 the rates totalled 4/-d. Overseers Rate Book October 1848 The property is now shown as being owned by ASPINALL
Church Rate Book 21st November 1850 and 15th January 1852 Rateable Value of Beer House £8. 0s. 0d. and rates 1/4d. 1852 House called Bridge End, Rateable Value £5. 15s. 0d. rates 1/5 1/2d. later 11 1/2d. addresses on his death certificate with no success. 19/11/2008 - Used ancestry and
entered "Northumberland", "Newcastle" and "born 1821 +/- 2" but still no success.

In 1851, at 48 Newmarket Road, Holy Trinity, Cambridge, Cambridgeshire there was an Ann MARTIN, Butcher. Originally it was thought that this was this Ann WHEATON who had married again, as in the same property was an Elizabeth SARGEANT, (26) servant, and Ann E SARGEANT (3) Visitor and three WHEATON children who are shows as the son and daughters of Ann MARTIN.

There are uncertainties about this entry. More investigation is needed
* No marriage for William WHEATON and Ann SEARJANT has been found
* There is no Ann WHEATON marriage to a MARTIN before 1851. William WHEATON was not transported until 1852. Perhaps she was not married to William and therefore married a MARTIN in the name of SEARJANT
* on the birth certificate of William born 21st August 1838 his parents are shown as William WHEATON (Butcher) and Ann WHEATON formerly SEARJANT
* on the 1841 Census there is a William, age 2, son of William (Butcher) and Ann WHEATON living with Elizabeth and Mary in Sun Street. (Elizabeth is shown as 15 so is probably not a daughter, and is most certainly the Elizabeth SARGEANT on the 1851 Census aged 26)
* on the 1851 Census there is a William age 12, and with sisters Ann and Jane at 48 Newmarket Street.
* No marriage for daughter Ann was found, but there was one for a Sarah Ann which seemed possible, so this has been included for the present.

A Nonagenarian
Mrs Mary Wheaton, who resides on Crowle Moor is, we understand, Crowle's oldest inhabitant. She celebrated her 93rd birthday on Wednesday the 13th inst. Out of her family of twelve children only three are still living; but she has thirteen grandchildren, and fourteen great grandchildren. Although blind, and somewhat infirm, she is remarkably bright and cheery, and still takes a deep interest in current events. She has been a member of the Baptist Church for fifty-one years and today is its oldest member.
